Terms of Sale | GetOut

1. Purpose

These terms of sale govern transactions made through the GetOut platform between users and partner sports facilities. The seller is the GetOut entity corresponding to the country of the sports venue: GetOut France (SAS, SIRET 940 361 678 00011) for venues in France and Europe, GetOut, Inc. for venues in the United States. GetOut acts as a technical intermediary facilitating connections and payments.

2. Prices

Booking prices are set by the sports facilities and displayed in the local currency (euros for venues in France and Europe, US dollars for venues in the United States). For venues in France, prices include all applicable taxes (TTC). For venues in the United States, applicable taxes (sales tax) may be added to the displayed price and are shown before payment confirmation. Prices may vary by time slot, duration, number of participants and selected options. GetOut service fees may apply. The exact amount is clearly displayed on the payment page before order confirmation.

3. Payment

Payment is made online through our secure payment provider Stripe, PCI-DSS certified. Accepted payment methods are credit cards (Visa, Mastercard). Payment is charged upon booking confirmation and processed by the Stripe account of the GetOut entity corresponding to the venue's country (Stripe France for venues in France, Stripe US for venues in the United States). GetOut does not store your banking information.

4. Cancellation

Cancellation conditions vary by venue and are indicated at the time of booking. Generally, free cancellation is available up to a certain time before the activity starts. After that, cancellation fees may apply, up to the full booking amount.

5. Refunds

For cancellations within the allowed period, refunds are issued to the original payment method within 5 to 10 business days. For cancellations by the venue, refunds are full and automatic.

6. Right of Withdrawal

In accordance with consumer protection laws, the right of withdrawal does not apply to leisure services to be provided on a specific date. Sports facility bookings are therefore not subject to the right of withdrawal.

7. Subscriptions

Some facilities offer subscriptions through the platform. Renewal, cancellation and pricing conditions are specific to each subscription and detailed before sign-up. Subscriptions can be cancelled from your account settings.

8. Liability

GetOut acts as a technical intermediary. The sports facility is responsible for the service. GetOut cannot be held liable for the quality of facilities, cancellation by the venue or any damage occurring during sports activities.

9. Disputes

In case of a dispute, please contact us first at [email protected] to find an amicable solution. In accordance with French consumer protection law, you may use the following consumer mediator free of charge: CNPM Consumer Mediation, 27 avenue de la Libération, 42400 Saint-Chamond, France, www.cnpm-mediation-consommation.eu. You may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr. Any unresolved dispute will be submitted to the competent courts.
