1. Acceptance
By accessing the GetOut platform (website getout.sport and mobile application), you agree to be bound by these terms of use. If you do not accept these terms, you must not use the platform.
2. Services
GetOut is a platform for searching, booking and managing sports activities at partner facilities. The platform is operated by GetOut France (SAS, SIRET 940 361 678 00011) for services in France and Europe, and by GetOut, Inc. (Illinois, USA) for services in the United States. We connect users with sports venues. GetOut does not own the facilities and is not responsible for the quality of services provided by the venues.
3. User Account
To access certain features, you must create an account. You are responsible for keeping your credentials confidential and for all activity under your account. You agree to provide accurate information and keep it up to date. GetOut reserves the right to suspend or delete any account that violates these terms.
4. Bookings
Bookings made through the platform constitute a commitment. Cancellation and modification conditions vary by venue and are indicated at the time of booking. GetOut acts as a technical intermediary and is not a party to the contract between the user and the venue.
5. Payment
Payments are processed by Stripe, a PCI-DSS certified third-party provider. GetOut does not store your banking information. Prices are displayed including tax and may vary by venue, time slot and selected options.
6. User Content
By posting content (reviews, comments, photos) on the platform, you grant GetOut a non-exclusive, worldwide, royalty-free license to use, reproduce and display this content on the platform. You remain responsible for your content and warrant that it does not infringe any third-party rights.
7. Prohibited Activities
It is prohibited to use the platform for: any illegal activity, impersonating another person, distributing offensive or harmful content, attempting unauthorized access to GetOut systems, using bots or automated scripts, interfering with the operation of the platform.
8. Intellectual Property
The platform and its content (text, graphics, logos, software) are the property of GetOut France and GetOut, Inc. and protected by intellectual property laws. No license is granted beyond the right to personal, non-commercial use of the platform.
9. Limitation of Liability
GetOut provides the platform "as is". We do not guarantee that the platform will be available without interruption or free of errors. Our liability is limited to the amount of fees paid to GetOut in the six months preceding the claim. GetOut is not liable for indirect, incidental or consequential damages.
10. Termination
You may delete your account at any time. GetOut reserves the right to suspend or terminate your access for violation of these terms, without notice or compensation.
11. Governing Law
For services provided by GetOut France (venues in France and Europe), these terms are governed by French law and disputes shall be submitted to the competent French courts. For services provided by GetOut, Inc. (venues in the United States), these terms are governed by the laws of the State of Illinois. In all cases, mandatory consumer protection provisions of your country of residence remain applicable.
